EMI Sues Cash Money Records A Second Time For Non Payment Of Royalties



Birdman and Slim are having to deal with yet another lawsuit involving non payment of royalties. This one involves music giant EMI.

EMI alleges they are owed nearly $500,000 from the label that is home to Lil Wayne, Nicki Minaj and Drake. This lawsuit stems from a previous one in 2009, when EMI sued Cash Money for copyright infringement. The suit was settled and a payment plan was put in place to compensate EMI for songs that Cash Money Records' artists illegally sampled.

EMI is now suing again, alleging the payments from Cash Money have stopped according to Courthouse News.

"Because Defendant has ignored numerous communications from EMI regarding Defendant's contractual obligations, EMI once more is being forced to commence a lawsuit against Defendant to recover royalty payments," the complaint states.
According to the parties' agreement, EMI is entitled to a multiplier penalty of 1.25, which means Cash Money owes more than $491,000 in damages.
 "The sales of Defendant's products have far exceeded the payments that EMI has received," the complaint states. "Once EMI realized that Defendant owed more money under the Second Payment it notified Defendant and explained that due to the increased sales, EMI was entitled to additional compensation."

 "It is clear from Defendant's conduct that it has no intention of honoring the Agreement."
